Washington Co. second-degree murder case visits Carter Co.

A judge hailing from near Maryville heard arguments on a Washington County second-degree murder charge in a Carter County courtroom Wednesday.

The hearing was held in Carter County Criminal Court Wednesday morning because presiding Judge Jon Kerry Blackwood was scheduled to hold court there, District Attorney General Tony Clark said.

Clark said Dale Larkin is being tried again because a Knoxville Court of Appeals overturned his 2011 conviction on first-degree murder and insurance fraud charges in the 2003 death of his wife.

“Basically the court of appeals said on first-degree murder, we could not retry him on that charge because it would be double jeopardy, but we could retry him on second-degree murder,” Clark said.
