Man charged in 2012 deaths seeks to exclude evidence

Before deciding whether to exclude potential evidence against one of three men charged in the 2012 deaths of a Carter County man and woman, Judge Robert Cupp asked the state to provide specifics on how that evidence will be used.

Jeffery Lynn Whitehead and his attorneys, Gene G. Scott Jr. and Jerome Cochran, appeared in court Monday to determine if video and statements from Whitehead’s co-defendants, Jonathan Scott Shell and Tyler Daniel Shell, would be used as evidence against him.

All three men have been charged with first-degree murder and conspiracy to commit first-degree murder in the June 2012 deaths of Joyce Brock and Russell Glenn Shell.
